3. This website www.quantumcapture.com (hereinafter the “Website”) is owned and operated Quantum Capture Inc., a corporation resident in and incorporated pursuant to the laws of the Province of Ontario, Canada (Hereinafter “Quantum”, “we” or “us” as context permits).
4. If you acquire a license to use any Software or Content created by us, be it through the Website or through any other means, the terms and conditions contained in our corresponding License Agreement with you will apply to the purchase and sale transaction.
Website Access
5. The Website is made available free of charge. Notwithstanding any Website content or anything contained herein we do not guarantee, represent or warrant that the Website, or any Website content, will be available at any given time or will be uninterrupted. Access to the Website is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of the Website at any time without notice.
6. You are responsible for making any and all arrangements necessary for you to access the Website. You are responsible for configuring your information technology, computer programs and platform in order to access our site. You should use your own virus protection software.
7. You are also responsible for ensuring that any and all persons who access our site through your internet connection are aware of and comply with each of the individual terms and conditions contained herein.

10. Any unauthorized use of the Website or breach of any one or more term or condition contained herein shall be grounds for termination of your use of the Website.

By accessing and using the Website, you agree that we may collect personal information from you in certain areas of the Website in order to provide you with information about our products and services, to personalize your visit to our website and fulfill your online purchases. It is important to note that we will never sell, rent or license any of our customer’s personal information to any third party. Viruses
31. We do not guarantee that the Website will be secure or free from bugs or viruses. You are responsible for obtaining and using appropriate computer security and protection software.
32. You must not misuse the Website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorized access to the Website, the server on which the Website is stored or any server, computer or database connected to the Website. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. We will report any breach of this provision to any and all relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Website and any Licensed Content pursuant to our License Agreement with you will cease immediately.
General Provisions
33. Quantum’s failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any term, condition, provision, or right.
34. If all or part of any provision of this Agreement is wholly or partially unenforceable, the parties or, in the event the parties are unable to agree, a court of competent jurisdiction, shall put in place of such whole or part provision an enforceable provision or provisions, that as nearly as possible reflects the terms of the unenforceable whole or part provision. Notwithstanding anything contained herein, the invalidity or unenforceability of any part of this Agreement shall not affect the validity or enforceability of the balance hereof.
35. Use of the Website and each of the terms and conditions contained herein are governed by the laws of Canada and the Province of Ontario therein. You agree and consent to the exclusive jurisdiction and courts of Canada and the Province of Ontario as applicable.
